A lawsuit filed by Tesoro Refining and Marketing Co. against the California Air Resources Board seeking to prevent the use of up to 10 percent ethanol in each gallon of gasoline sold in California will be dismissed with prejudice, according to a news release from the Renewable Fuels Association.
